RESOLUTION PASSED BY THE PAKISTAN BAR COUNCIL IN ITS 197TH MEETING HELD ON 07-11-2012 AT ISLAMABAD WITH MR. AKHTAR HUSSAIN, VICE-CHAIRMAN, PAKISTAN BAR COUNCIL IN THE CHAIR.
“Whereas this Council has received a letter from the Registrar, Supreme Court of Pakistan for the nomination of its representative to the Judicial Commission of Pakistan; and
Whereas the Pakistan Bar Council being the apex body of the legal fraternity and one of the stake holders has time and again emphasized that process of appointment of Judges to the superior Judiciary should be transparent; and
Whereas it is imperative that appointment of Judges to the superior Judiciary be made of really practicing profession Lawyer of competence and integrity; and
Whereas it is desirable that nominees of the Bar Councils to Judicial Commission of Pakistan should be meaningfully consulted in respect of the appointment of Judges right from the time of initiation and preparation of list of proposed names; and
Whereas this Council has also emphasized that not only that it should be meaningfully consulted in the process of appointment of Judges but should also have a hand in initiating the names of proposed Judges; and
Whereas this Council strongly believes that the above objectives cannot be achieved till the Rules framed by the Judicial Commission of Pakistan are suitably amended;
Therefore, this Council resolves to defer the nomination of its representative to the Judicial Commission of Pakistan for the time being and shall make efforts that positive steps are taken to attain the aforementioned objectives and the relevant Rules are suitably amended.
This Council has further decided to constitute a Committee consisting of Vice-Chairman, Chairman, Executive Committee, Pakistan Bar Council, and any other Member of the Pakistan Bar Council and President, Supreme Court Bar Association to call upon the Hon’ble Chief Justice for apprising him about the above situation.”
